Yes I had one pending and no RFE was received for either. My lawyer is expecting a notification from USCIS stating the second one is withdrawn.

I think the fact that you had same A# helped you despite multiple filings. There are cases of people where even though they have declared their second application, USCIS assigned them a second A# number.

If it is a quarterly report I dont understand why they ran it in the middle of a quarter? This report should be run at the end of the quarter. Not in 1600AD what USCIS considers to be 2009.

I have a question regarding the I-693 Medical exam. it was mentioned that you will need to take a vaccine for MMR, Varicella, Tetanus and Hapatitis B. it was also mentioned that they will do a tb test and a blood test for HIV and syphilis. are these all the vaccinations and blood tests required or are there aother blood test required in addition to these??

Below are the list that I have from my lawyer to prepare my I-485 :

which confirms that the job on which visa petition is based is still
available to you. The letter must also state the salary that will be paid.

10 Fee Payment made to USCIS (1 per applicant)

Hi,
We have already made plans for our India trip. We will be leaving US on June 2nd. Can we apply 485 on June 1st and leave to India on June 2nd.
Will there be any complications around this.
As we will be returning in July, we are not sure if my PD will still be current by the time we return back.

Like everyone else i periodically come to IV and get to know the trends of whats happening. Thanks to everyone like qsek,teddy,vdlrao and many more who are contributing and trying to get some clarity into the backlog mess.
Having made a one time contribution was enough to get access to donor forum or so i thought. I really did not know that you need to have a recurring payment to get access to the donor forum.Most paid content websites may have that model but somehow I am uncomfortable with that idea here, and i am sure there are others who may feel the same.
Come up with a one time payment for one years access. It could be 300.00 USD to start with which is the same as 25.00 USD for 12 months which is the minimum you guys have set up. Many more will be comfortable with that.
Its just like rubbing me on the right side and you get my money ;), a trick which my wife exploits to the fullest :rolleyes:

Please post any document where USCIS admit that they are working with July 2nd cases. I didn't get any document in USCIS website. May be i missed ? Or Well Officially they are telling that they are working with July end/August start filers but CSR Level 1 says in phone. bla bla. :D

If you can restart ur app in Eb2, you should be fine dates wise. Unless CIR messes it up.
Approximately 2 months for PERM and then you can file 140+485 concurrently.

Now that my date is current, the company A is saying they cannot give me an employment letter because they are not doing well financially. The company has not more than 3-4 employees and they had been suffering losses for last few years. Now even if they have good intentions for me, they are unable to file for me.
What options do I have now? restart GC process with company B and utilize my priority date?
Please help. For a day I was excited about my date getting current but after al there was no reason for me to be happy.

Been here since 1998. Filed labor in 01 but was revoked due to tech downturn. Filed again in 05. Fortunately my GC was approved last Aug.
I think the final goal for most folks is citizenship.. including some of those who dont want to stay here permanently. Waiting 15 - 20 years for citizenship makes no sense.. if they are thinking of giving it to illegals in 10 years, whats wrong in asking?

I dont know of any link to a particular publication, but I thought it was a common knowledge that the whole point of labor certification process, is for the DOL to monitor that a potential US worker (I thought it meant US Citizen but may be not), is not being displaced by a foreign worker. To be clear here though, the DOL does not prevent an employer from going ahead and sponsoring an H1B and hiring a foreign employee. But DOL is legally directed to reject such labor applications.
Though this is applicable only for H1B hiring and subsequent filing of GC process for such an employee, I am wondering whether there is any loophole in DOL's directives that might provide a cover for employers to enquire whether a propective employee is US Citizens are not.... Especailly in the PERM process don't they have to do active recruiting efforts and gather statiscis that they tried to hire US citizens ..?? How can an employer gather statistics if they didn't ask for work authorization related details....?

On the contrary, the employment laws explicitly prohibits discrimination based on nationality and immigration status. The whole point of PERM is to protect the "US worker", not just US citizen. I'm not sure whether USCIS ever *appologized* per say but the second paragraph from the link above supports my earlier argument that the new spill-over policy (which in my personal opinion is more rational) is not a random, ad hoc decision by USCIS but rather a careful one after consulting congress etc.
This is not a proof that DOS apologized. Ron Gotcher is a good lawyer but what he mentioned on his blog cann't be used in court. Anyways, thanks.

LC substitution is not wrong if you look at what it was intended to do. Employment based greencard application is an employer's application and he has the right to give it to whomever he wants to.( especially when an employee leaves him)
The issue was that this provision was misused by many employers.

I applied on Feb 12 and got my EAD yesterday.. This is my 4th EAD and from NSC.. I applied 3 1/2 months before my current one expires..

Its same CPO. I have read in the forms here that it could take up to 2-3 weeks since the date of approval to receive the cards in hand.
